Criminal Record Check

Eswatini's criminal-clearance document is the Police Clearance Certificate, issued by the Royal Eswatini Police Service (REPS), which also holds responsibility for internal security and border and customs control. The certificate, sometimes referred to regionally as a good conduct certificate or judicial record extract, confirms whether an applicant has a known arrest, conviction, or criminal proceeding on record.

Employment verification is generally most reliable with established employers in Mbabane and Manzini, Eswatini's main administrative and commercial centres. Education verification should be conducted directly with the issuing institution.

Data Protection & Consent

Screening in Eswatini is governed by the Data Protection Act 5 of 2022, effective from 4 March 2022, which governs the collection, processing, storage, and disclosure of personal information. The Act applies to any organisation processing personal data of people in Eswatini, regardless of size — explicitly including employers maintaining staff records or CV databases. Non-compliance can result in fines of up to E5,000,000 or 2% of annual turnover, whichever is applicable. Employers should ensure documented candidate consent is in place before initiating any screening.
