Somalia has, on paper, one of the more current data protection frameworks in the region — but a fingerprint-based, largely manual criminal record process, combined with an active and worsening al-Shabaab insurgency, means employers should treat verification here as substantially higher-effort than most African markets.

Criminal Record Check

Somalia's criminal-clearance document is the Certificate of Good Conduct (Police Clearance Certificate), issued by the Somali Police Force's Criminal Investigation Department (CID) headquarters in Mogadishu. The process is fingerprint-based: applicants have fingerprints and palm prints recorded on a prescribed form at the nearest police station, then forward the application — including a clear copy of their ID card, fingerprints, and a covering letter — to CID Headquarters in Mogadishu. Applicants located in Somaliland or Puntland apply through the relevant local police authority in those regions rather than through Mogadishu.

Operational Context: Security Situation

Somalia's Federal Government, with African Union-mandated support, continues to hold Mogadishu, but al-Shabaab remains a persistent and, by some accounts, resurgent threat: the group has carried out high-profile bombings and assassination attempts in the capital through 2025 and into 2026, and has recaptured towns in the Lower Shabelle region following the withdrawal of African Union forces. Al-Shabaab has specifically targeted business people who resist its influence, and many businesses continue paying informal taxes to the group. For employers, this means verification processes tied to Mogadishu-based institutions, and travel or fieldwork required to complete them, carry materially higher operational risk and uncertainty than in most other African markets.

Employment & Education Verification

Verification is most reliable, though still subject to the security caveats above, for candidates connected to Mogadishu-based institutions under Federal Government control. Verification for candidates connected to Somaliland or Puntland runs through separate regional authorities and should be scoped accordingly.

Data Protection & Consent

Screening in Somalia is governed by the Data Protection Act, Law No. 005 of 2023, enforced by the Somalia Data Protection Authority (DPA). The Act applies to processing of personal data by controllers based or operating in Somalia, and to processing that targets or monitors individuals in Somalia. Employers should ensure documented candidate consent is in place before initiating any screening involving Somali nationals or residents.

Practical Notes for Employers

• Confirm whether a candidate's record is tied to Federal Government-controlled Mogadishu, Somaliland, or Puntland before initiating verification — the process and authority differ by region.
• Build significant contingency time and independent corroboration into any Somalia-related screening given the active security situation.
• Apply Data Protection Act 2023 consent and processing requirements, now that Somalia has an active regulator overseeing them.
